Reduction of Year-Old Cases During the 2021-2022 fiscal year, the Prosecution Services Unit (PSU) continued its downward trajectory for one year-and-older cases. PSU reduced the total number of cases that had not been completed within one year by 6.3% to a total of 1,156 cases. Of that total, 43.4% were from 2021, meaning those cases were only one year old. PSU worked to reduce the one year-and-older inventory by prioritizing probable cause recommendations on the oldest cases under legal review and by referring the oldest cases with a finding of probable cause to the Division of Administrative Hearings (DOAH) for final hearing. As the oldest cases are resolved, attorneys will be able to allocate more time to resolving more recent complaints. In 2021-2022, PSU resolved 4,228 total complaints, 572 of which were over one year old. PSU issued 293 emergency restriction and suspension orders and referred 64 cases to DOAH. Twenty of the cases referred to DOAH resulted in full evidentiary hearings and recommended orders being presented to six different boards for final action. MQA’s Annual Report and Long-Range Plan must provide a status of the development and implementation of rules providing for disciplinary guidelines, as required by section 456.026(9), Florida Statutes.
